These terms cover two things: using this website, including the voice demos on it, and engaging us to build and run a voice AI agent for your business. Plain language, because you should be able to read them once and know what you are agreeing to.

Who you are dealing with

Talk Society is operated by Talk Society LLC, 1111 Lincoln Road, Suite 500, Miami Beach, FL 33139, United States. In these terms "we", "us" and "Talk Society" mean Talk Society LLC, and "you" means the person or business using the site or engaging us.

What we do

We design, build, host and run custom voice AI agents — software that holds a spoken conversation with your customers, candidates or staff over the telephone or in a web browser, and that takes the actions you have asked it to take, such as booking, quoting, qualifying or logging a request.

Everything specific to your build — what the agent does, which systems it connects to, what it is allowed to say, the price, the timeline and who owns what — is set out in the written proposal or order form we agree with you. Where that document and these terms disagree, that document wins.

The demos on this website

The demos are demonstrations, not a service you are buying, and the businesses in them are invented. The clinic, the garage, the restaurant, the dealership and the rest do not exist; no appointment, order, quote, trade-in valuation or application made in a demo is real, and nothing in one creates any obligation on anybody.

Please do not put real personal information into a demo — not your customers' details, not a patient's, not a candidate's, and not anything confidential. Use made-up details; that is what the scenarios are designed for. Every demo conversation is transcribed and kept, which the privacy notice explains in full.

Demos are provided as they are, and we may change, limit or withdraw them at any time. The site applies fair-use limits so that everybody can try them.

Talking to our own AI, and booking a meeting

"Talk to our AI" is a real conversation with Talk Society's own agent about your business. It is an AI, and it says so. It can take your name, your company, what you want built, your phone number and your email address, read them back to you for correction, and book a meeting with us — which puts an event in our calendar and sends a calendar invitation to the address you gave. A booked meeting is an appointment to talk. It is not a contract, a quote or a commitment by either of us.

An AI can mishear, and it can be wrong. Please check what it reads back to you, and correct anything it got wrong on the form afterwards or by email. Nothing our AI says on a call is a binding quote or a promise about what your agent will do; the written proposal is.

Fees, and what a build costs

Our published starting points are a small build from $1,000, typically delivered in about a week, and $12 per hour of talk time once your agent is live. They are starting points, not a quote: the price for your build is the one in your proposal.

Nothing is owed for using this site or its demos. Fees become payable only under a proposal or order form you have accepted, on the invoicing terms it sets out. Talk time is measured by the minute while your agent is connected to a caller. Prices are in U.S. dollars and exclude any taxes, which are yours to pay where they apply.

What you are responsible for

  • Lawful use. You use the site, the demos and any agent we build for you lawfully, and in line with our acceptable use policy, which forms part of these terms.
  • Consent for calls and messages. If your agent calls or texts people, you are responsible for having a lawful basis to contact them — including consent where the law requires it, honouring opt-outs and do-not-call requests, and calling only at permitted times. We will build the controls; you own the decision about who is called.
  • Your content and your data. You have the rights to the scripts, records, recordings, customer data and systems you give us or connect to your agent, and giving them to us does not break any obligation you owe somebody else.
  • Your own regulation. If you work in a regulated field — health, finance, law, insurance, hiring — you remain responsible for meeting the rules that apply to you. We will design to them where you tell us what they are, but we do not assume your compliance duties.
  • Accurate information. What you tell us about your business, your hours, your prices and your services is what the agent will say.

What an AI agent is, and is not

Every agent we build identifies itself as an AI. We do not build agents that claim to be human, and we will not do so on request.

An AI agent can mishear, misunderstand or be wrong, and the underlying speech and language models are probabilistic. Agents are built to hand a conversation to a person when it matters, and every consequential decision — who is hired, what is charged, what is refunded, what is clinically appropriate — stays with a person on your side. An agent is not a source of medical, legal, financial or other professional advice, and it is not an emergency service; agents are built to direct a caller in an emergency to the emergency services, and never to handle one.

Who owns what

We keep everything we brought or built generally: our platform, our tooling, our prompts, patterns and know-how, this website and our brand. You keep everything you brought: your content, your data, your customer records, your brand.

Unless your proposal says otherwise, once you have paid for your build you get a perpetual, worldwide licence to use the agent configuration we produced for you for your own business, and we may keep using the general techniques and improvements we learned in the process, provided we do not use your confidential information or your data to do it.

Confidentiality

Each of us will keep the other's non-public information confidential, use it only to do the work, and protect it as carefully as our own. That does not apply to information which is already public, which we already had, which we get properly from somebody else, or which we have to disclose by law — in which case we will tell you where we are allowed to.

Services we build on

Our agents run on third-party services — speech and language models, telephony, hosting, scheduling and email. They are listed on our subprocessors page. We choose them carefully and remain responsible to you for the service, but their availability is not something we control.

Availability

We work to keep live agents answering. We do not promise the website, the demos or any agent will be available without interruption or free of faults, except where your proposal contains a service-level commitment, in which case that commitment applies.

No warranties

The website and the demos are provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent the law allows. Services we deliver under a proposal are provided with reasonable skill and care.

Limitation of liability

To the fullest extent allowed by law, Talk Society LLC is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill, arising out of the site, the demos or the services. Our total liability for all claims relating to the services is limited to the fees you paid us in the twelve months before the claim; for the website and the demos, for which you pay nothing, our total liability is limited to one hundred U.S. dollars. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.

Ending things

You can stop using the site at any time. We may suspend or withdraw access to the site or the demos if they are being misused. An engagement ends the way its proposal says it ends; if it is silent, either of us may end it on thirty days' written notice, you pay for work done up to that point, and we will give you a reasonable hand-over.

Changes to these terms

We may update these terms as the service develops. If we make a material change we will update the date at the top of this page, and where a change affects a live engagement we will tell you. Continuing to use the site after a change means you accept the updated terms; a signed proposal keeps the terms it was signed under unless we agree otherwise.

Law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction. If any part of these terms is unenforceable, the rest stands.
